What to do if you are thinking about divorce

1.  Think of your children first

Old Lake County CourthouseLake County, Indiana's local rules of family law place the best interest of the children as their top priority.  "In all family cases with children, the goal will be protecting the best interests of those children," states local family law rule 2.  You should do the same yourself.  Divorce is a difficult time for the parents going through it.  It's is even tougher for the children, so you'll want to make sure that they are well taken care of at this time.  Make sure to spend extra time with your kids.  Try to keep their life as close to normal as you can keep it while you are going through a divorce.  Do not talk to your children about your spouse or use them as spies.  Lake County provides excellent resources for parents involved in family law matters that can be of great assistance during these times.

2.  Set up an appointment with an attorney right away

Law officeYou'll want to obtain legal counsel to protect your interests.  You'll want to speak with your lawyer to discuss the circumstances of your case so that you and your lawyer can figure out the best way to go about your case.  Even if you decide not to file for divorce, it is always a good idea to make sure that your interests are protected during difficult times.

3.  Make copies of household bills, other important paperwork, including pay stubs and make a list of household property

Lake County's local rules require mandatory financial disclosure, so making copies of your financial records will save you time and effort when it comes time to exchange financial information.  It also allows you and your attorney to obtain a picture of your family's financial situation that might be useful in your divorce case.  If you can ascertain what your spouse earns, i.e. your husband or wife receives a paycheck, make a copy of that as well since it will be critical in determining child support.  Lake County's local rules regarding financial disclosure will also require that you list valuable items.  Making a list now will save you time when it comes time to prepare the disclosures.  It also provides the court with a record should valuable items go missing at a later date.

4.  Review your budget and expenses

Chris Hedges law licensesAt some point in your case, the court may make determinations about who will pay certain bills while the case is pending.  Knowing where the household budget is spent will help you and your attorney if there comes a time that the court has to make such a decision.  Having a clear picture of your financial situation -- income and expenses -- will help you to make financial decisions before, during and after the divorce.

5.  Do financial planning for the future

You are separating and eventually divorcing your spouse.  You'll want to make sure that your finances are such that you'll be able to take care of the necessities, such as housing, bills, and other necessary payments.  You'll also want to save you money to pay for a lawyer's retainer and court costs.  You'll want to review your budget and plan for taking care of your finances without the help your spouse.

6.  Seek out family counseling, if needed

Divorce is a stressful time.  Sometimes it helps to have someone to discuss issues with that aren't necessarily related to your legal issues.  This is where a family counselor can give you strategies for coping with stressful situations.  It will also be beneficial for your children, as well, since divorce is stressful for children as well.
